1. Acceptance of Terms
Welcome to WeedNearby.com ("WeedNearby," "we," "us," or "our"). WeedNearby is a cannabis dispensary directory service that connects consumers with licensed cannabis dispensaries. By accessing or using our website at weednearby.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Site.
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Site with an updated effective date. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 21 years of age to access or use the Site. By using the Site, you represent and warrant that you are at least 21 years old and have the legal capacity to enter into these Terms. If you are accessing the Site on behalf of a business (e.g., as a dispensary owner), you represent that you have the authority to bind that business to these Terms.
3. Description of Service
WeedNearby is a directory and informational platform that provides:
- A searchable directory of licensed cannabis dispensaries
- Dispensary business information including addresses, hours of operation, phone numbers, and menus
- Tools for dispensary owners to claim, manage, and update their business listings
- Product and menu browsing functionality
- A waitlist and notification system for upcoming launches in new areas
WeedNearby is not a cannabis retailer, distributor, or delivery service. We do not sell, distribute, or facilitate the sale of cannabis or cannabis products. We do not process payments for cannabis transactions. We are an informational directory only.
4. User Accounts
4.1 Account Registration
Certain features of the Site may require you to create an account. When you register, you agree to provide accurate, current, and complete information and to update that information to keep it accurate and complete.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.
4.3 Account Termination
We reserve the right to suspend or terminate any account at our sole discretion, with or without notice, for any reason, including violation of these Terms. You may also delete your account at any time by contacting us.
5. Dispensary Owner Terms
5.1 Claiming a Listing
Dispensary owners or authorized representatives may claim their business listing on WeedNearby. By claiming a listing, you represent and warrant that you are the owner or an authorized representative of the dispensary and have the legal authority to manage the listing on behalf of the business.
5.2 Listing Content
When you manage a dispensary listing, you are responsible for the accuracy and legality of all content you provide, including but not limited to: business name, address, and contact information; hours of operation; menu items, product names, descriptions, images, and pricing; cannabis license information; and any promotional or descriptive content.
You represent and warrant that all information you provide is accurate, current, complies with all applicable state and local laws, and does not infringe on any third-party intellectual property rights.
5.3 Compliance with Cannabis Regulations
Dispensary owners are solely responsible for ensuring that their listings, product descriptions, pricing, and promotional content comply with all applicable federal, state, and local laws and regulations, including but not limited to cannabis advertising restrictions, licensing requirements, and consumer protection laws.
5.4 License Verification
We reserve the right to verify cannabis business licenses and may remove or suspend listings that cannot be verified or that belong to businesses without valid, active licenses.
5.5 Free Listings
WeedNearby currently offers free dispensary listings. We reserve the right to introduce paid features, premium placements, or subscription services in the future. Any paid services will be subject to additional terms and communicated to dispensary owners in advance.
6. Publicly Available Dispensary Data
WeedNearby may collect and display publicly available information about licensed cannabis dispensaries, including data from state licensing databases, public business registrations, and other public sources. We display this information to help consumers find licensed dispensaries. If you are a dispensary owner and wish to claim, update, or request removal of your listing, please contact us.
7. User Conduct
By using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation
- Provide false, misleading, or fraudulent information
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Attempt to gain unauthorized access to any part of the Site, other accounts, or any systems or networks connected to the Site
- Use any automated system, including bots, crawlers, or scrapers, to access the Site without our express written permission
- Interfere with or disrupt the Site or the servers or networks that host the Site
- Post, upload, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Use the Site to advertise or promote any unlicensed or illegal cannabis activity
- Harvest or collect email addresses or other personal information of other users
8. Intellectual Property
8.1 Our Content
The Site and its original content (excluding user-generated content), features, and functionality are owned by WeedNearby and are protected by copyright, trademark, and other intellectual property laws. The WeedNearby name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use these marks without our prior written permission.
8.2 User Content
By posting or submitting content to the Site (including dispensary listings, menu items, images, and descriptions), you grant WeedNearby a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, modify, and distribute that content in connection with the operation of the Site and our services. You retain ownership of your content, but you grant us the right to display it as part of our directory service.
9. Third-Party Content and Links
The Site may contain links to third-party websites, services, or content that are not owned or controlled by WeedNearby. We do not endorse or assume responsibility for any third-party content, websites, or services. You access third-party content at your own risk and subject to the terms and conditions of those third parties.
10. Disclaimer of Warranties
The site and all content, features, and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
Without limiting the foregoing, we make no warranties or representations regarding:
- The accuracy, completeness, or reliability of any dispensary listings, menu information, pricing, product descriptions, or other content
- The availability, quality, safety, or legality of any products or services offered by dispensaries listed on the Site
- The licensing status, regulatory compliance, or business practices of any listed dispensary
- The continuous, uninterrupted, or error-free operation of the Site
WeedNearby does not guarantee that any dispensary information displayed on the Site is current or accurate. Consumers should independently verify dispensary hours, menu availability, pricing, and licensing status before visiting.
11. Limitation of Liability
To the maximum extent permitted by law, WeedNearby and its operators, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Site.
In no event shall our total liability to you for all claims arising out of or relating to the Site or these Terms exceed one hundred U.S. dollars ($100.00).
WeedNearby is not responsible for any transactions, interactions, disputes, or issues between users and dispensaries. Any purchases, orders, or interactions with dispensaries are solely between you and the dispensary.
12. Indemnification
You agree to indemnify, defend, and hold harmless WeedNearby and its operators, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Site or violation of these Terms
- Any content you post or submit to the Site
- Your violation of any law, regulation, or third-party rights
- Any interaction between you and a dispensary or other user facilitated through the Site
13. Cannabis-Specific Disclaimers
WeedNearby provides information about cannabis dispensaries for informational purposes only. Please be aware of the following:
- Cannabis remains illegal under federal law in the United States. WeedNearby does not encourage or facilitate any activity that violates federal, state, or local law.
- State and local cannabis laws vary significantly. It is your responsibility to understand and comply with the laws applicable to your jurisdiction.
- WeedNearby does not verify the potency, purity, safety, or quality of any cannabis products listed on the Site. Product information is provided by dispensaries and has not been independently verified.
- Nothing on the Site constitutes medical advice. Cannabis products are not approved by the FDA to treat, cure, or prevent any disease. Consult a healthcare professional before using cannabis products.
- Cannabis should not be used by anyone under the age of 21 or by anyone for whom cannabis use is medically contraindicated.
14. Waitlist and Email Communications
By signing up for our waitlist or notification service, you consent to receive email communications from WeedNearby, including launch notifications, updates, and promotional content. You may unsubscribe at any time by clicking the unsubscribe link included in every email or by contacting us directly.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WeedNearby regarding the use of the Site and supersede any prior agreements or understandings.
